Terms of Use Agreement
IMPORTANT -- READ CAREFULLY:
This Terms of Use Agreement ("Agreement")
is a legal agreement between you and First Northern
Credit Union (“Credit
Union” including Credit Union employees and
other parties authorized to conduct screen sharing)
which governs your access to and receipt of support
from Credit Union to remote access of your home
computer system to analyze problems, sources of
problems, and when appropriate, to fix problems
accessing the Credit Union’s internet bank
website (“website”).
By clicking on "Accept" you
agree to be bound by the terms of this Agreement.
In addition, by utilizing this Screen Sharing Service,
you will be deemed to have accepted the terms of
this Agreement.
You agree that you are a member
of the Credit Union, and the purpose of this Agreement
is to assist in getting website access from your
home computer to your Credit Union accounts. You
agree that your computer is not being used primarily
for income producing business purposes.
You
agree that the computer being accessed under this
Agreement is owned by you, and that you have authority
to make this Agreement. You understand
that it is your responsibility to make back-up
copies of any data on your computer’s hard
drive.
You agree that you own legal copies
of any operating system (Windows, Mac OS, Linux),
anti-virus and other software that may be related
to your ability to access Credit Union’s
website. When possible, Credit Union will advise
you if you need to reinstall software, update and
run your anti-virus software or download and/or
purchase software to correct any problem. Credit
Union will not offer software for sale. Any
recommendations to use certain software, regardless
of whether it is free or not, are outside the scope
of this Agreement; Credit Union is not responsible
for any operating system or software decisions
you make.
In order for Credit Union to effectively
diagnose your problem, you agree to provide Credit
Union remote access to your computer’s desktop
screen and other applications in your computer
in accordance with the instructions provided by
Credit Union employees. Some machine configuration
data and personally identifiable information may
need to be temporarily collected. This information
will not be maintained after the conclusion of
the screen sharing session. You understand that
by allowing screen sharing, Credit Union will be
able to view all objects on your computer’s
desktop screen. Prior to approving this Agreement
and allowing screen sharing access, you should
close and/or remove any item on your desktop that
you consider personal in nature. For more
information about the Credit Union’s information
collection and use practices, please refer to the
Credit Union’s Privacy Statement.
Credit
Union makes no promise, guarantee or warranty that
it can repair the problem(s) associated with access
of your home computer to the website. Credit Union
will not diagnose or repair any other problems
with your home computer. Credit Union may,
at its expense and with your permission, use a
third party provider under this Agreement. This
Agreement covers the use of any third party provider.
CREDIT
UNION DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS
REGARDING THE USE OR THE RESULTS OF ANY EFFORTS
UNDERTAKEN PURSUANT TO THIS AGREEMENT
LIMITATION OF LIABILITY;
CREDIT UNION ASSUMES NO LIABILITY FOR CONSEQUENTIAL DAMAGES TO
THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. IN NO EVENT
SHALL CREDIT UNION BE LIABLE FOR ANY DIRECT, SPECIAL,
INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES
WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES
FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION,
LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY
LOSS) ARISING OUT OF THIS AGREEMENT. IN NO
EVENT SHALL OUR LIABILITY EXCEED 25.00 USD.
Credit
Union reserves the right to change the terms of
this Agreement.
Credit Union may terminate this Agreement at any
time.
This Agreement is governed by the laws of the
State of Illinois.
